A mid-level court, in reversing a judge, said the state Department of Environmental Conservation has authority for its more stringent interpretation of an ambiguous statute.
The agency requires restoring an inactive hazardous waste site to its pre-disposal condition to the extent feasible, and at minimum eliminating or mitigating all significant threats to public health and the environment.
A coalition of businesses contends the DEC has exceeded its statutory authority.
Oral arguments are set for Monday afternoon.
