NY Court Upholds Ethics Commission Subpoena Power

New York's top court won't hear the appeal from the ex-chief of the State University of New York Research Foundation accused of giving a no-show job to the daughter of a powerful legislator.

The Court of Appeals, rejecting without comment John O'Connor's request, leaves intact a lower court's ruling that state ethics officials can subpoena his testimony.

The midlevel court concluded the Commission on Public Integrity had statutory subpoena authority even after finding reason to believe there was an ethics violation in O'Connor's hiring of then-Senate Majority Leader Joseph Bruno's daughter.

Susan Bruno resigned in 2009 over questions about her qualifications.

A spokesman says the Joint Commission on Public Ethics, which replaced the earlier commission, will proceed with the case.
