Federal prosecutors have recommended that a teen who sent death threats to a Vermont high school be sentenced to probation despite his violation of court orders.
Prosecutors maintained their recommendation of a five-year probation sentence for 19-year-old Josiah Leach. Leach pleaded guilty last year to transmitting threats including a "murder list" targeting 16 students and staff at South Burlington High School.
The Burlington Free Press reports a judge ruled in November that Leach had violated his conditions of release by being discharged from a mental health program. Prosecutors say Leach was discharged when he set off three smoke bombs on separate occasions causing staff to have to leave the building.
Leach's attorney is also asking for probation.
A sentencing hearing is scheduled for Tuesday.
