Judge Dismisses Suit Concerning Proposed Tuxedo Casino

A judge has dismissed a lawsuit filed against an Orange County town over a proposed casino. This comes as a decision on casino license recipients in upstate New York is expected December 17.

The lawsuit was filed in July on behalf of 18 residents who live within a few miles of Genting America’s proposed Sterling Forest Resort in the Town of Tuxedo. They filed suit against the Tuxedo Town Board alleging that it skipped an environmental review prior to a vote in June adopting a gaming overlay zone. Bridget Morris is one of the residents who brought the legal action.

“The judge did not rule that the lawsuit was without merit,” says Morris. “What he ruled was basically that we sued too soon.”

Morris says that if a license is granted for the Tuxedo site, she and other residents would challenge the town and this time Genting in court.
