Oneida Indian Lawsuit Against Finger Lakes Casino Dismissed

A judge has dismissed a legal challenge by the Oneida Indians to a casino under construction in the Finger Lakes that would compete with the tribe's casino.

State Supreme Court Justice Vincent Reilly ruled in a decision released Friday the Oneida Indian Nation lacks standing to pursue their lawsuit seeking to nullify the license for the del Lago Resort & Casino. The tribe claims state regulators violated lawful procedures.

Lago is scheduled to open next year 65 miles west of the tribe's Turning Stone casino. The Oneidas claimed their financial injuries gave them standing, but the judge said speculative future losses don't meet the legal burden.

A state Gaming Commission spokesman said they were pleased with the decision.
