Brattleboro, VT – A federal judge is set to hear opening arguments in a trial in which Entergy Corporation is trying to keep the Vermont Yankee nuclear plant open in spite of the state's efforts to close the plant when its initial 40-year license expires next March. Trial begins today in U.S. District Court in Brattleboro in a case in which Entergy is arguing that the state of Vermont is preempted by the federal Atomic Energy Act from closing its lone reactor down.
The state Legislature has denied the plant the certificate of public good it needs to operate past next March, while the federal NRC has found that Vermont Yankee is fit to operate for another 20 years.
