Millionaire Murder Suspect To Face New Trial In Schoharie County

An upstate New York businessman tried for murder three times after the disappearance of his estranged wife is scheduled to face a fourth trial in March.

Prosecutors claim Calvin Harris killed Michele Harris in September 2001 when she returned to the Southern Tier home they shared with their four young children. Her body was never found, and prosecutors relied on a largely circumstantial case.

A judge in May declared a mistrial in the third murder case against Harris when a jury failed to reach a verdict after 11 days. Harris' previous two convictions were overturned.

The fourth trial was scheduled on Wednesday for March 2, 2016, in Schoharie County.

Defense lawyers filed a motion seeking a dismissal of the indictment and argued that another trial amounted to double jeopardy.
