Albany Law School Professor Robert Heverly recently filed an amicus brief in the Supreme Court case Department of Homeland Security vs. MacLean on behalf of advocacy organization FlyersRights.org
As part of the case, the court will decide if a U.S. air marshal can be protected under the Whistle Blower Protection act after sharing information about the service to the press.
Robert MacLean, an air marshal, went to the press in 2003 after learning some air marshals would be removed from certain of routes due to budget cuts, at a time when the U.S. was under threat of potential terrorist attacks.
WAMC’s Lucas Willard spoke with Heverly who gave some background on the case, and shared his argument that air travelers have a right to know information that could impact their safety.
