Albany, NY – A grand jury has decided not to charge a former state trooper who ran over a drunken man lying on a rural upstate New York road and then left the scene. WAMC's Tristan O'Neill reports...

A special prosecutor tells local media Tuesday that the jurors dropped a pending felony charge of leaving the scene of a fatal accident against 32-year-old Brian Beardsley.

Beardsley was off duty when his pickup hit 29-year-old Chad Finch just after 2:30 a.m. on May 22 in Broadalbin, 35 miles northwest of Albany. Beardsley's girlfriend called 911 to report a body in the road before they drove off.

Investigators who tracked down the call determined Beardsley was not intoxicated. State police have said he's no longer a trooper, but wouldn't say if he resigned or was fired.

Authorities said it wasn't clear if Finch was alive when he was run over.
