No Charges To Be Filed In Drowning Death Of Toddler

Prosecutors say no charges will be filed in the drowning death of a Vermont toddler who was in foster care.
The 2-year-old boy was found unconscious in a family pool in East Montpelier on July 5 and later died.

The child — Alexander James Lowell-Henry — was in the custody of the Vermont Department of Children and Families and living with a foster family at the time.

The Washington County state's attorney's office said Thursday that evidence and current state of the law limit its likelihood of proving beyond a reasonable doubt any offense.

The office says "this was a preventable tragedy" that would not likely have happened if the caretaker had adequately supervised the child and ensured that proper fencing had been installed around the pool.
