Lawyers Hope Death Penalty Retrial Starts in Fall of 2016

Attorneys involved in the death penalty retrial of a Vermont man hope the trial can begin in the early fall of 2016.

The  tentative trial date is set in Rutland.

Thirty-four-year-old Donald Fell was sentenced to death for the 2000 killing of 53-year-old Terry King, of North Clarendon, who was abducted when she arrived for work at a Rutland supermarket.

Last year a federal judge ordered a new trial for Fell after it was revealed that one of the jurors in the original 2005 trial investigated the details of the case on his own.

At a pretrial hearing on Friday, Fell appeared gaunt in a black-and-white prison jump suit from a New York county jail and remained chained throughout the 20 minute hearing.
