Judge Rules That Lawsuit Over Nuclear Plant Subsidies In NYS May Proceed

The New York State Supreme Court has rejected motions to dismiss a lawsuit against the Public Service Commission that challenges subsidies for upstate nuclear plants.

The lawsuit was brought by Hudson River Sloop Clearwater and others in 2016 against the New York state PSC and nuclear plant owners over ratepayer subsidies to the upstate plants under the Clean Energy Standard. Clearwater alleges that the PSC is not following the law in mandating up to $7.6 billion in such subsidies over 12 years to aging nuclear plants. Clearwater Environmental Director Manna Jo Greene called the ruling a “David vs. Goliath victory.” The case is now headed to trial.
