Judge Tosses Riverkeeper Lawsuit Concerning A Power Plant

A state judge has dismissed an environmental group's lawsuit challenging the restart of a Hudson Valley power plant using natural gas instead of coal.

The suit was filed by Riverkeeper. The Poughkeepsie Journal reports that a judge in Albany County dismissed the case, saying Riverkeeper had no legal standing to bring the suit to court. The petition sought a halt to resumption of operations at the 500-megawatt Danskammer power plant in Newburgh. Riverkeeper argued the state Public Service Commission violated state law because it failed to require a full environmental review before authorizing the reactivation. The old coal-fired plant was shut down in November 2012 after being damaged by Superstorm Sandy. It went back online in January under new ownership.
