A New York State Supreme Court decision has upheld the right of two Hudson Valley groups to challenge a town planning board’s decision about a proposed telecommunications tower in Columbia County.
A judge has denied a motion by Eger Communications to dismiss a legal challenge to the July 2013 Town of Livingston Planning Board approval of a 190-foot replacement telecommunications tower, which the challengers said would be in direct view of the Olana State Historic Site. The challenge comes from The Olana Partnership and environmental group Scenic Hudson, where Jeffrey Anzevino is Land Use Advocacy director.
“The views from the Olana State Historic Site are very important, and the tower that’s been proposed there on Blue Hill doesn’t need to be as tall or as visible as it has been proposed by Eger Communications.”
When reached Tuesday afternoon, Mark Eger said he had not yet seen the ruling and therefore could not comment.
