No Criminal Charges In Central Ave. Fatality

The driver of a truck that struck and killed a young boy at a dangerous Albany intersection is to appear in traffic court February 1st.

Albany police have issued James Kelly nearly two dozen citations stemming from the February 12, 2015 incident at Quail Street and Central Avenue. Kelly was behind the wheel when his ICS garbage truck struck and killed a 4-year-old boy who was in the crosswalk with his mother.  Citations include "Failure to exercise due care" and "Failure to yield to a pedestrian in a crosswalk" as well as driving an uninspected motor vehicle whose brakes were "out of service." The truck also had numerous defective lights and low tire treads.

No criminal charges have been filed against Kelly, and no charges of any kind against the trucking company.

Dave began his radio career as a “morning personality” at WABY in Albany.
