Berkshire Museum Seeks Trial In Lower Court

The Berkshire Museum is renewing calls for a trial at a lower court in Pittsfield, Massachusetts to settle the legal battle over its art controversial sale. The museum wants to sell off art from its collection to fund an endowment and expansion.

Lawyers for the Berkshire Museum filed papers Monday night calling for a trial in Berkshire Superior Court in Pittsfield to accelerate the legal dispute while aspects of the case are under review in the Appeals Court in Boston. 

The lower court ruled in the museum’s favor in November.

If approved, the motion would reverse the Appeals Court judge’s stay on legal actions until the injunction on the planned sale concludes Sunday.

State Attorney General Maura Healey can ask to extend the injunction while her office continues its investigation.  

In November, the museum’s lawyers sought an expedited trial, hoping to advance the sale. They contend the injunction puts the museum in “precarious financial condition.”
