Families Of Two HV Men Killed In Train-Car Collision File Suit

The families of two Hudson Valley men killed last year when a Metro-North train struck an SUV have filed negligence lawsuits against the railroad and its engineer.

The Journal News (http://lohud.us/1PSbFrj ) says lawyers for the families of Joseph Nadol of Ossining and Robert Dirks of Chappaqua are seeking an unspecified amount in damages. Westchester County and the town of Mount Pleasant also are named as defendants. It does not name Ellen Brody, the 49-year-old woman who was killed when the train struck her SUV at a grade crossing in Valhalla. Five train passengers also were killed, including Nadol and Dirks. The lawsuits allege a poorly designed crossing and an engineer too slow to apply the brakes were to blame for the February 3, 2015 deaths. Metro-North declined to comment. The Mount Pleasant supervisor says he is hopeful the case will be resolved in the town's favor.
