Farmworker Collective Bargaining Lawsuit Challenged

In May, the New York Civil Liberties Union filed suit against New York state, seeking to allow farmworkers’ collective bargaining rights.  The New York Farm Bureau is now challenging the lawsuit.
The lawsuit filed by the ACLU seeks to overturn the exclusion of farmworkers from the State Employment Relations Act.   

The New York Farm Bureau is critical of the lawsuit.  President Dean Norton announced Monday morning it is filing a motion to gain intervenor status and simultaneously a motion to dismiss the lawsuit.  “The lawsuit that has been filed by the New York Civil Liberties Union seeks to circumvent the legislative process and turn to the judicial system to make law.  This is unacceptable to us.”

Governor Andrew Cuomo has said his administration will not challenge the lawsuit.
