A settlement has been reached in Berkshire Superior Court that will allow for the development of a residential recovery center for women with eating disorders in Lenox, Massachusetts.

In February, a lawsuit was filed in Berkshire Superior Court challenging the Lenox Zoning Board of Appeal’s approval to convert a residence into an in-patient center for women with eating disorders.

The court dismissed the case with prejudice – terminating the right to an appeal – on October 6th.

The settlement reinforces the town’s land-use restriction agreement: the women’s center will be limited to 23 rooms for up to 48 residents, and cannot be used for drug or alcohol treatment.

It’s expected to open by May 2019.
