KINGSTON – Republican Ulster County Legislator Kevin Roberts, who represents the Town of Plattekill, looks like he may have clear sailing in the November election.

Roberts, who will also appear on the Independence Party line, had a challenge from Democrat Miguel Garcia, who sought an opportunity to ballot to appear on that line.  The State Supreme Court in Kingston on Tuesday ruled the request invalid.

The court also tossed Garcia’s Democratic Party petitions because of irregularities, said Roberts.

“A couple of these signatures were witnessed by Mr. Garcia. As it turned out, one of couples came in (Tuesday) and the wife admitted she signed for the husband and that appears to be the fatal flaw because Mr. Garcia witnessed that forgery,” Roberts said.

While Roberts said Garcia could apply for an opportunity to ballot for the Democrat line, he doubts a judge would approve it.
