Judge Dismisses Case Against Rensselaer County DA

A judge has dismissed criminal charges that were brought against Rensselaer County District Attorney Joel Abelove by New York’s attorney general. 

The charges of perjury and official misconduct followed the Republican DA’s grand jury investigation of a deadly April 2016 shooting by a Troy police officer during a traffic stop, but State Supreme Court Justice Jonathan Nichols ruled the state attorney general did not have jurisdiction in the case and exceeded his authority.

A statement issued by the attorney general's office Monday afternoon says the “indictment detailed a disturbing pattern of misconduct that violated the law and undermined a criminal investigation.” The statement says the office is “now determining how to best to move this critical case forward.”
