A Vermont court has denied an opioid manufacturer’s motion to dismiss claims brought by the state against the company.
Vermont sued Purdue Pharma regarding its marketing of OxyContin and other opioid products, claiming that over years the company aggressively marketed the drugs while minimizing the risk of addiction. The state also claims that the company “tainted the science around pain management with misinformation.”
Perdue Pharma argues that the state is preempted by federal law based on prescription drug advertising.
Superior Court Judge Helen Toor denied the drug company’s motion to dismiss.
