In documents filed Monday in the court of appeals for the District of Columbia, the Department of Public Service argued the Nuclear Regulatory Commission violated the Clean Water Act when it approved the permit extension without proof the plant was in compliance.
The Brattleboro Reformer says the state and the anti-nuclear group the New England Coalition claim the NRC ignored its regulations requiring a clean water certificate.
The NRC extended the plant's federal operating license for 20 years beyond the March expiration of the current license.
The state wants the plant shut down.
