NYS AG: Nurse Allegedly Slapped Resident In Nursing Home

A nurse has been charged for allegedly striking a resident in a Dutchess County nursing home.

New York Attorney General Eric Schneiderman Wednesday announced the arrest of Maria Fernandez, a 53-year-old licensed practical nurse, for allegedly slapping an 83-year-old, wheelchair-bound resident in the dining hall of Victory Lake Nursing Center in the Town of Hyde Park. Fernandez, who no longer works at the facility, faces a felony endangerment charge, and up to four years in prison if found guilty. Schneiderman says the incident was caught on surveillance camera. The resident, whose identity is being kept confidential, suffers from dementia and other ailments.  Fernandez, who pleaded not guilty, was arraigned and released on her own recognizance. She’s due in court January 22.
