Albany Settles 'Excessive Force' Lawsuit

Albany taxpayers will be responsible to pay off a newly settled lawsuit involving a city policeman.

A former UAlbany student punched in the head three times by police officer Robert Lawyer,  who, in October 2011, answered the call of a loud party on Partridge Street is to receive 70-thousand dollars.

The Times Union reports city officials approved the payment to Myles Hernandez on Tuesday- admitting no wrongdoing as part of the settlement of Hernandez's 2012 federal lawsuit alleging excessive force, false arrest, malicious prosecution and racial discrimination.

Hernandez, who is African-American and Hispanic, was the only person arrested at 94 Partridge that night. He was charged with misdemeanor obstructing governmental administration and resisting arrest—

A city judge later dismissed the charge.  The lawyer representing Albany in the case declined to comment.
