Lenox, Massachusetts police say a bicyclist has died from injuries sustained in an accident at an intersection described as “concerning.”

Police say 29-year-old Benjamin Kaplan of Westchester County, New York entered the intersection of East Street and Housatonic Street and collided with a Clifford Oil Company delivery truck that had the right of way on May 5th.

“Many of the witnesses say that they observed him with what appeared to be a very out-of-control manner and were fearful that the bicyclist wasn’t going to be able to stop," said Lenox police chief Stephen O’Brien. "That indeed was the case.”

Kaplan died from his injuries on Sunday at a Long Island hospital.

O’Brien – who says the Lenox PD are familiar with the busy intersection – says no charges will be filed in the matter.
