Court Dismisses Westchester Suit Against Federal Government

WHITE PLAINS, N.Y. (AP) — Westchester County has suffered a loss in federal court in its long battle over a fair housing settlement.

A judge Thursday dismissed a county challenge to the government's plan to withhold $7.4 million in 2011 community development funds. The U.S. Department of Housing and Urban Development had said it would send the money elsewhere unless Westchester filed an acceptable so-called analysis of impediments, which is an analysis of local zoning. The analysis was one of the requirements of the 2009 settlement of a lawsuit. Westchester has done several analyses concluding there are no impediments to fair housing. HUD officials say the analyses have been unacceptable. In a letter last week, HUD demanded that Westchester undertake a new analysis, following specific instructions. A county spokesman said he hoped HUD would allow the state to administer the community development funds.
