A state Supreme Court judge has ruled that Westchester County Executive Rob Astorino’s lawsuits against New York officials and others over a deal to close the Indian Point nuclear power plant will be heard in Westchester.
Attorneys for Governor Andrew Cuomo and other state officials named in the lawsuits had requested that the proceedings be moved to Albany. Acting State Supreme Court Judge Helen Blackwood has denied that request, saying that Indian Point is at the very epicenter of what led to the deal reached to close the Buchanan-based plant by 2021. Astorino is suing Cuomo, state officials, Riverkeeper and Indian Point parent company Entergy over what he calls a “three men in a room” deal reached prematurely. Astorino also is suing saying the state failed to conduct an environmental review before announcing the closure. A Cuomo spokesman has previously said Astorino is wrong on the facts and the law.
