Feds Won't Seek Prison For NY Senator Guilty Of Lying To FBI

Federal prosecutors say they will not seek prison time for a New York state senator convicted of lying to the FBI about arranging a high-paying job for his son because the former lawmaker is terminally ill.

Prosecutors recommended in a filing Monday that Tom Libous be sentenced to house arrest and a fine but didn't give specifics.

Court papers say Libous has been undergoing treatment for cancer.

He lost his seat as the Senate's deputy majority leader after being convicted in July. Prosecutors say he lied to agents who were investigating government corruption. The agents were asking how Libous' son Matthew got a $150,000-a-year job with a White Plains law firm.

Libous' attorney did not immediately respond to a request for comment. He is scheduled to be sentenced Nov. 24.
